Atom Signs & Print
1. Definitions
- “Company” refers to Atom Signs cc trading as Atom Signs & Print.
- “Customer” refers to any individual, business, or entity purchasing goods or services from the Company.
- “Products” refers to signage, large format printing, 3D signage, signboards, frames, LED signs, stickers, vehicle branding, wallpaper, and any related goods.
- “Services” refers to design, manufacturing, installation, and branding services provided by the Company.
- “Agreement” refers to these Terms and Conditions, together with any quotation, invoice, or purchase order accepted by the Customer.
2. Scope of Agreement
These Terms apply to all quotations, orders, sales, and services provided by the Company. No other terms, conditions, or representations shall be binding unless expressly agreed to in writing by the Company.
3. Orders and Payments
- Quotations are valid only for the period stated therein.
- Orders are binding upon submission of a purchase order or payment of a deposit.
- Payment terms:
- Orders under R10,000 (including VAT): full payment required upfront.
- Orders R10,000 or more (including VAT): 70% deposit required upfront, balance of 30% strictly payable prior to installation, delivery, or collection.
- Customer 30-day accounts are offered solely at the discretion of the Company. No application process is required, and the Company reserves the right to withdraw or amend account terms at any time.
- The Company reserves the right to suspend work or withhold delivery until all payments are received in accordance with these Terms. ALL products provided by the company remain property of Atom Signs & Print until paid in full, and the company reserves the right to remove its products without notice to recover costs.
4. Manufacturing and Installation
- Manufacturing times vary between 5–10 working days or longer depending on complexity.
- Installations may only be scheduled once manufacturing nears completion.
- Installation may take up to five (5) additional business days after completion.
- All timelines are estimates only; the Company provides no guarantees regarding completion or installation dates.
5. Returns, Refunds, and Cancellations
- No returns, refunds, or cancellations are permitted once payment has been received or a purchase order has been submitted.
- The Customer acknowledges that all Products are custom-made and therefore exempt from return or refund under the Consumer Protection Act.
6. Warranties
- Materials carry a minimum three (3) year manufacturer warranty from date of invoice.
- The Company provides a one (1) year workmanship warranty from date of invoice.
- After one (1) year, the Customer is liable for all labour costs associated with repairs. Damaged components will be submitted to the manufacturer for warranty claims. If the manufacturer does not provide a replacement, the Company bears no responsibility.
7. Limitation of Liability
- The Company shall not be liable for:
- Damages arising during installation.
- Errors in installation.
- Unexpected damages due to material use or application.
- Indirect, consequential, or incidental damages.
- The Company maintains public liability insurance, but liability is strictly limited to the extent covered by such insurance.
- The Customer indemnifies the Company against any claims arising from misuse, improper installation, or failure to comply with safety standards.
8. Intellectual Property
- The Company retains full ownership of all designs, mockups, and artworks created during the design and approval process.
- Production files will never be shared with Customers to protect the integrity of the Company’s processes.
- The Company reserves the right to showcase any completed work (unless legally restricted by contract) in portfolios, galleries, social media, and other promotional platforms.
9. Electrical Work
- The Company does not provide electrical connections, and is a service that must be requested beforehand for either client or Atom Signs & Print to organise a certified electrician.
- A qualified electrician must complete all 230V connections and issue a certificate of compliance.
- The Client bears full responsibility for ensuring compliance with electrical safety regulations.
10. Right to Refuse Service
- The Company reserves the right to decline work deemed unsafe, misaligned with Company values, or involving unpleasant or abusive clients.
- The Company may suspend or terminate services without liability if the Customer breaches these Terms.
11. Compliance and Documentation
- The Company holds all required certifications and compliance documents.
- Copies are available upon request for a fee, including inclusion in a safety file.
- The Customer is responsible for ensuring compliance with any site-specific safety requirements.
12. Governing Law and Disputes
- These Terms are governed by the laws of the Republic of South Africa.
- The Company does not provide dispute resolution mechanisms. The Company’s decision shall be final in any dispute.
- Staff and stakeholders of the Company are immune from any litigation arising
